Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the MyPilotCRM platform, website, and related services (collectively, the "Service") provided by Elite Marketing Group LLC ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Service, you ("Customer," "you," or "your") agree to be bound by these Terms.
If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Service.
2. Description of Service
MyPilotCRM is a software-as-a-service (SaaS) platform that provides customer relationship management and business automation tools, including but not limited to:
- Contact and lead management (CRM)
- Sales pipeline tracking
- Email and SMS marketing and automation
- Missed call text-back automation
- Appointment scheduling and calendar management
- Reputation and review management
- Call tracking
- Website chat widget
- AI-powered assistant features
- Reporting and analytics dashboard
- Landing page and funnel builder
The specific features available to you depend on your subscription plan. We reserve the right to modify, update, or discontinue features with reasonable notice.
3. Account Registration & Security
To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to: (a) provide true and accurate registration information; (b) maintain and promptly update your information; (c) keep your password secure and confidential; (d) notify us immediately of any unauthorized access to your account; and (e) accept responsibility for all activities under your account.
4. Subscription Plans & Billing
4.1 Plans and Pricing
MyPilotCRM offers the following subscription plans:
- Starter: $297 per month (one-time setup fee: $497)
- Growth: $497 per month (one-time setup fee: $997)
- Pro: $997 per month (one-time setup fee: $1,497)
Pricing is subject to change with 30 days' written notice. Existing subscribers will be honored at their current rate for the remainder of their billing cycle.
4.2 Billing
Subscription fees are billed monthly on a recurring basis, beginning on the date of your initial subscription. Payments are processed through Stripe and may be made via credit card or ACH bank transfer. All fees are quoted in U.S. dollars.
4.3 Auto-Renewal
Your subscription automatically renews each month unless cancelled in accordance with Section 5. By subscribing, you authorize us to charge your payment method on file for each renewal period.
4.4 Setup Fees
One-time setup fees cover the custom configuration of your account, including pipeline setup, automation configuration, and integration setup. Setup fees are charged at the time of account creation and are non-refundable.
4.5 Additional Charges
Certain usage-based charges may apply for SMS messages, phone minutes, and email sends beyond your plan's included limits. These charges will be clearly communicated before they are incurred.
5. Cancellation & Refunds
5.1 Cancellation by Customer
You may cancel your subscription at any time by providing written notice to hello@mypilotcrm.com at least 30 days before your next billing date. Upon cancellation:
- Your account will remain active until the end of your current billing period
- No refunds will be issued for partial months
- Setup fees are non-refundable
- You will have 30 days after your account is deactivated to export your data
5.2 Cancellation by Company
We reserve the right to suspend or terminate your account for violation of these Terms, non-payment, or other reasons outlined in Section 15. We will provide reasonable notice when possible.
6. Acceptable Use Policy
You agree to use the Service in compliance with all applicable laws and regulations. Specifically, you agree NOT to:
- Send unsolicited messages (spam) via SMS, email, or any other channel
- Violate the Telephone Consumer Protection Act (TCPA) or CAN-SPAM Act
- Send messages to contacts who have not provided explicit opt-in consent
- Use the Service for any illegal, fraudulent, or harmful purpose
- Transmit malware, viruses, or malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Resell, sublicense, or redistribute the Service without authorization
- Use the Service in a way that disrupts or overburdens our infrastructure
- Collect or harvest personal information of third parties without consent
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account.
7. Intellectual Property
7.1 Our Property
The Service, including all software, designs, text, graphics, interfaces, and underlying technology, is the property of Elite Marketing Group LLC and/or its licensors. These Terms do not grant you any ownership rights to the Service.
7.2 Your Content
You retain all rights to the data, content, and materials you upload, create, or store within the Service ("Customer Content"). You grant us a limited license to host, store, process, and display your Customer Content solely for the purpose of providing the Service.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you agree to the terms of our Privacy Policy.
You are responsible for ensuring that your collection and use of customer data through the Service complies with all applicable privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and the General Data Protection Regulation (GDPR) where applicable.
9. SMS/Text Messaging Program
9.1 Description of SMS Program
MyPilotCRM (operated by Elite Marketing Group LLC) offers an SMS messaging program as part of the Service. When you or your contacts opt in, messages may include: appointment confirmations and reminders, missed call follow-ups, onboarding updates, review requests, lead follow-up communications, and service-related notifications.
9.2 Opt-In
By providing a phone number through our website forms, booking calendars, or by calling our business number and providing consent, you or your contacts agree to receive recurring SMS messages from MyPilotCRM. Consent is not a condition of purchase.
9.3 Opt-Out Instructions
You can cancel SMS messages at any time by texting STOP to any message sent from MyPilotCRM. After sending STOP, you will receive a one-time confirmation message. No further messages will be sent unless you opt in again.

9.5 Message Frequency and Data Rates
Message frequency varies based on your activity and interactions. Standard message and data rates may apply depending on your mobile carrier and plan. MyPilotCRM is not responsible for any charges imposed by your carrier.
9.6 Carrier Liability
Carriers, including T-Mobile, are not liable for delayed or undelivered messages.
9.7 Age Restriction
You must be at least 18 years of age to opt in to our SMS messaging program.
9.8 Privacy and No Sharing
Your SMS opt-in data and consent will never be sold, rented, or shared with third parties or affiliates for their marketing purposes. See our Privacy Policy for complete details on how we handle your information.
10. Third-Party Services
The Service integrates with and relies on third-party services, including but not limited to:
- GoHighLevel: Platform infrastructure
- Twilio: SMS and voice communication
- Stripe: Payment processing
- Google: Reviews, calendar integrations, analytics
- Amazon Web Services: Cloud hosting
We are not responsible for the availability, performance, or policies of third-party services. Your use of third-party services is subject to their respective terms and conditions.
11. Service Availability
We strive to maintain high availability of the Service but do not guarantee 100% uptime. The Service may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control.
We will make reasonable efforts to notify you of scheduled maintenance in advance. For customers on the Pro plan, specific uptime commitments are outlined in your Service Level Agreement (SLA).
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELITE MARKETING GROUP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO US DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
13. Indemnification
You agree to indemnify, defend, and hold harmless Elite Marketing Group LLC, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your Customer Content.
14. Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
14.2 Informal Resolution
Before initiating any formal dispute resolution, you agree to contact us at hello@mypilotcrm.com and attempt to resolve the dispute informally for at least 30 days.
14.3 Arbitration
If a dispute cannot be resolved informally, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the State of California. The arbitrator's decision shall be final and binding.
14.4 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.
15. Modifications to Terms
We may update these Terms from time to time. When we make material changes, we will notify you via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
If you do not agree to the updated Terms, you may cancel your subscription before the changes take effect.
16. Termination
We may suspend or terminate your access to the Service immediately if: (a) you violate these Terms or the Acceptable Use Policy; (b) your account is past due for more than 15 days; (c) we are required to do so by law; or (d) we discontinue the Service entirely (with 90 days' notice).
Upon termination, your right to use the Service ceases immediately. Your data will be available for export for 30 days following termination, after which it may be permanently deleted.
17. General Provisions
17.1 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Elite Marketing Group LLC regarding the Service and supersede all prior agreements.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
17.3 Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
17.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
